LiveWire is committed to protecting your privacy. As such, we
adhere to the following privacy policy and have voluntarily agreed to
comply with the Safe Harbor provisions as developed by the US Department
of Commerce and approved by the European Community.
Information Collection
LiveWire collects and stores non-personal information about your visit
for internal statistical purposes. This data may include: the name of
domain from which you access the Internet; date and time you access our
site; the Internet address of the website from which you linked directly
to our site; information you view while visiting our web site. We may
also collect personally-identifiable information on certain areas of our
site (e.g. when users register and/or apply for jobs). We do this to provide
services you request and to better serve our customers needs. LiveWire
does not disclose, sell or transfer any personal information to any third
parties.
Privacy of Data Not Collected Via the Web Site
LiveWire may perform consulting services, such as data hosting, for clients
during which it may be given access to personally-identifiable information
of European Union Citizens employed by the client or client customers.
This information is received only in the course of performing consulting
services. We receive this information solely pursuant to written contracts.
The information is not used for any purposes other than those specified
in the contract.
LiveWire has enacted and follows precautions to safeguard the privacy
of client data, including requiring all employees, third-party subcontractors,
or vendors (having access to this information), to sign confidentiality
agreements.
Any third party sub-contractor or vendor working for LiveWire and having
access to this information through LiveWire is (1) contractually required
to comply with LiveWire’s privacy policy, (2) is subject to the
European directive or other adequacy finding, or (3) independently ascribes
to the safe harbor provisions itself.
Where LiveWire acts only as an agent for the collection of client data,
all data transfers occur only upon direction of the owner of the data,
LiveWire’s client.
CHOICE
Acting only as an agent for its clients, LiveWire is not required to provide
persons whose personally-indentifiable information is provided by LiveWire’s
clients an opportunity to choose or opt-out whether the personal information
will be disclosed. However, LiveWire does not use customer data for any
purpose incompatible with those authorized in its client agreements.
SENSITIVE INFORMATION
Sensitive Information, including credit card numbers, is not stored except
as directed by the LiveWire’s clients who own the data, and is not
transferred to third parties except as authorized by client.
ONWARD TRANSFER
LiveWire will not transfer clients' data except with the written authorization
of the client. Where LiveWire uses third party sub-contractors or vendors
having access to client data through LiveWire they are (1) contractually
required to comply with LiveWire’s privacy policy, (2) subject to
the European directive or other adequacy finding, or (3) independently
ascribe to the safe harbor provisions themselves.
SECURITY
LiveWire maintains reasonable precautions to protect personally-identifiable
information from loss, misuse and unauthorized disclosure, alteration
or destruction. Only authorized users, bound by employee confidentiality
agreements, have access to such stored data.
DATA INTEGRITY
LiveWire collects only that data authorized by the client. Where LiveWire
is directed by its clients to transfer data to a third party, LiveWire
follows the data masking and confidentiality provisions agreed to by the
client and third party.
ACCESS
LiveWire will correct, amend or delete any erroneous data if instructed
to do so by its clients, subject to the principles of proportionality
and reasonableness.
ENFORCEMENT
LiveWire will allow its clients reasonable access to verify LiveWire’s
commitment to adhere to the safe harbor principles, including transferring
a sample of data stored on its systems to the client. LiveWire will cooperate
with the EU Data Protection Authorities and the Department of Commerce
to resolve any complaints and disputes arising in connection with its
privacy policy. All LiveWire employees will be required to be familiar
with and adhere to this privacy policy. LiveWire will investigate any
reported complaints of violations of its privacy policy and will take
prompt remedial action where violations are found. Dispute resolution
provisions in LiveWire’s client contracts will be followed.
The above prohibitions against disclosure of personally-identifiable information
are subject only to the following exceptions:
- LiveWire may disclose your personally-identifiable information to
third parties as required by court order or rule or other similar order
or rule of any nation or state. Even in this circumstance, LiveWire
will do everything in its power to disclose only the data required by
applicable law or the authorities;
- LiveWire may disclose your personally-identifiable information to
third parties who deliver information from us to you for the purpose
of performing such delivery.
